The Coronavirus HOAX and Court Battles

On December 7th, The Daily Wire submitted expert analysis to the 6th Circuit Court of Appeals showing that the  Administration’s mandates are based on junk science, and there is no valid basis for such an unprecedented overreach of government power.

Here’s the latest news you need to know on the ongoing fight against the vaccine mandates.

Court Victories
 
The court victories continued last week in the fight for employee privacy and medical freedom. 

A U.S. district court in Georgia struck down the mandate requiring federally contracted employees to be vaccinated. The preliminary injunction by the court applies to “all covered [government] contracts in any state or territory of the United States of America.” 
 
The U.S. government contracts out thousands of private agencies, which in turn affects millions of employees. Millions.   
 
For those counting at home, pending further review, all federal mandates have been temporarily stayed. This includes the mandate for employers with over 100 employees; the mandate requiring staff working in Medicare or Medicaid certified providers and suppliers; and as of last week—the mandate aimed at federally contracted employees. 
 
Even with the temporary stay, can employers still mandate vaccinations for their employees? The answer is yes, they can, but without government enforcement, it proves risky. What if an employee has an adverse reaction to the vaccine and sues? What if an employee is fired or mistreated for noncompliance and makes claims of discrimination, ADA noncompliance, or something else? And what happens if a business chooses to collect COVID-19 health information from employees and accidentally runs afoul of privacy or document recordkeeping rules? Employers have good reason to hold off on enforcing a vaccine mandate. 

Private Companies Respond
 
If it sounds too good to be true, consider the list of large companies rescinding vaccination requirements, or at least temporarily staying them. 
 
Advent Health joined HCA Healthcare in removing its Covid-19 vaccine requirements for employees. The former is a healthcare system based in Florida and employs nearly 85,000 people. 
 
General Electric also announced they would no longer be requiring vaccines. They employ 56,000 in the United States. 
 
Oracle, the world’s second largest software company with 133,000 employees, will no longer mandate Covid-19 vaccinations, pending further court outcomes.

The Fight Continues
 
We still have a long fight before we can declare victory, but those fighting these authoritarian mandates should feel encouraged to know that the Daily Wire’s lawsuit, and the effort of businesses, states, and individuals to stand against Covid-19 vaccine mandates, continue to affect millions of livelihoods.  
 
In other words, we must keep fighting.

The halts on mandates and required vaccinations is good news but it’s only temporary until court outcomes are known. The above companies mandated vaccination before, and they may very well do it again. And while many employers have rescinded vaccine requirements, many others continue to support and uphold the mandates. 
 
Additionally, there are still states and localities that continue to push restrictions. Mayor Bill De Blasio announced last Monday that all employers, regardless of size, must require vaccination for employment in New York City. Additionally, children ages 5 to 11 will need to prove vaccination for indoor dining, fitness, and entertainment. 
 
Governor Gavin Newsom announced a universal indoor mask mandate for the entire state of California just this week. 
 
And despite the above court victories, the Biden Administration continues to double down on mandated Covid-19 vaccinations. Jen Psaki reiterated confidence in the mandates, vocalizing support for the DOJ and their fight to uphold the mandate in court.
 
Bottom Line
 
There have been encouraging victories, yes, but the fight has only just begun.
