The ABC has learned the Federal Government is close to signing off on a new asylum seeker policy.

Australia’s immigration policy was cast into limbo after the High Court scuttled the Malaysia asylum seeker deal more than a week ago.

It is understood the new policy will go to Cabinet on Monday morning before going to a special caucus meeting.

Attorney-General Robert McClelland says there will be intense discussion within his party about what kind of border protection policy to introduce.

Some in Labor’s Left faction want offshore processing abolished, and Mr McClelland admits it is a difficult policy area.

“I think the public would expect there’ll be an issue of debate and there’ll be arguments of substance put both ways,” he said.

“I don’t want to pre-empt that, but clearly there will be intense discussion and indeed debate about the matter.”

As the Government puts the final touches to its plan, the first asylum seeker boat to arrive since the High Court ruling has been intercepted off Christmas Island.

The boat’s 72 passengers and two crew were being transferred to the island for health and security checks.

Opposition border protection spokesman Michael Keenan says there is no doubt those on board are aware Australia’s border protection policy is in limbo.

“If we continue with this policy-free zone, then we’re going to continue to give the green light to people smugglers to bring people to Australia illegally,” he said.
