UPDATE: TONY Mokbel will undergo an angiogram today in St Vincent’s Hospital to determine the extent of damage to his heart, a judge heard today.


Judge Simon Whelan indicated he will not adjourn final submissions in a Supreme Court case where Mokbel, 46, is seeking to change his guilty plea to serious drug trafficking charges.

Mokbel was rushed to hospital from Barwon Prison yesterday after he experienced chest pains and shortness of breath.

Defence lawyer Peter Faris QC told the court they had been unable to get sufficient information about his client’s condition from the Department of Justice’s health department (Justice Health) because they would only speak to family members.

Mr Faris said he received a text from Mokbel’s solicitor Grace Morgan today which read: “More diagnostic tests. Unable to give diagnosis at this stage”.

Mr Faris said he believed Mokbel would have an angiogram today.

“That should indicate any blockages or damage to the heart,” he said.

Mokbel applied late last year to change his plea to charges of trafficking large commercial quantities of ecstasy and speed from guilty to not guilty.

He had pleaded guilty to the charges in April 2011 and was awaiting a pre-sentence plea hearing in the Supreme Court.

The application was made after a senior policeman admitted in an unrelated County Court case that affidavits were not being sworn or affirmed correctly, as required by law.

There are 12 affidavits in the Mokbel drugs cases which it is alleged were not properly sworn and he believes they should be ruled inadmissible along with any evidence gathered as a result of them.

Prosecutor  Peter Kidd SC has described the application “hopeless” and said there was a large amount of evidence against Mokbel which was not connected to impugned affidavits.

The hearing is continuing while lawyers seek an update on Mokbel’s condition.

A prison source said Mokbel had been exercising when he complained of chest pains he believed might have been caused by heat exhaustion.

It is understood doctors suspected he had a mild heart attack and were carrying out further tests, the source said.

A Department of Justice spokesman would not confirm Mokbel was the inmate, but said a 46-year-old man had been taken to hospital to receive treatment for a medical condition.

“Corrections Victoria does not discuss individual prisoners or their movements for security reasons,” he said.

Paramedics reached the prison just before midday yesterday, providing Mokbel with oxygen and aspirin.

Ambulance Victoria spokesman John Mullin said the patient was short of breath, sweaty and had nausea and dizziness.

“They’ve given him some aspirin and a bit of reassurance,” he said.

Mokbel arrived at St Vincent’s at about 6.30pm under heavy guard.

The convicted drug dealer, who is understood to have a history of heart problems, has been under increased pressure as he mounts the legal challenge to change his guilty plea.

He pleaded guilty in April to drug charges relating to him masterminding his drug gang while he was on the run in Victoria and Greece.
