Company Ordered to Reinstate Employees with Full Back Pay and Benefits; New Election to be Held
LAS VEGAS, Jan. 24, 2012 /PRNewswire-USNewswire/ — The National Labor Relations Board has ruled that Lucky Cab Company in Las Vegas, Nevada engaged in unfair labor practices by interfering with a union election and unlawfully terminating six employees for their activities on behalf of the union. A new election has been ordered without interference from the company and all terminated employees have been reinstated with full back earnings and other benefits.
The ruling by NLRB Administrative Law Judge, Lana H. Parke, is the result of unfair labor practice charges and timely objections to a representation election of May 6, 2011 filed by Industrial Technical and Professional Employees/Office and Professional Employees International Union (OPEIU) Local 4873. Judge Parke stated that Lucky “interfered with the employees’ exercise of a free and reasoned choice” and threatened “employees with loss of benefits and other reprisals by informing employees it would be futile to select the Union as their bargaining representative, by interrogating employees and by threatening to `hurt’ their employees.”
She also found that the company terminated six employees “because they engaged in union or other concerted, protected activities and to discourage employees from engaging in these activities.”

ITPE/OPEIU Local 4873 represents approximately 2,500 taxi drivers in Las Vegas employed at Yellow Checker Star and Henderson.
