Patel wins appeal to High Court

The High Court has agreed to hear an appeal from jailed surgeon Jayant Patel on the grounds he was tried under the wrong section of Queensland’s criminal code.

EMMA ALBERICI, PRESENTER: Jailed Queensland surgeon Jayant Patel has won the right to take an appeal against his convictions to the High Court.

In 2010, Patel was jailed for seven years for the manslaughter of three patients and the grievous bodily harm of another while he was a surgeon at Bundaberg Hospital.

This morning the High Court agreed to hear Patel’s appeal on the grounds that he was tried under the incorrect section of Queensland’s criminal code.

KERRY SMITH-DOUGLAS, PATEL’S LAWYER: This was his last chance but now’s he’s in the ballpark.

EMMA ALBERICI: The court has also asked Patel’s lawyers for more information about another possible ground of appeal, relating to an alleged miscarriage of justice. Former patients say the latest development is worrying.

BERYL CROSBY, PATIENT SUPPORT GROUP: A lot of people are just happy he’s in jail, a lot people are happy that he can’t ever practice again and won’t hurt anyone. There’s going to be angst around now. Will he be successful?

EMMA ALBERICI: The appeal is expected to take two days. A date for the hearing is yet to be set.
