Man charged over Christmas Day fatal crash

“The accused’s vehicle was positioned on the east-bound lanes, travelling on the wrong side of the road,” Sen-Constable Hancock said.

It’s alleged Mr Kang “felt a bump which lifted the wheels of the car” and it began to spin and skid before the passenger side of the sedan struck the tree.

Mr Kang suffered a broken left clavicle and minor bruising and was taken to hospital in a stable condition.

The court heard he had a blood alcohol reading of .061.

In applying for bail, Mr Kang, with his arm in a sling and wearing dark-shaded glasses, tried to convince Justice Peter Bongiorno he was not a risk to the community.

“I want to apply for bail because I can assure you I won’t be going anywhere,” Mr Kang said. “I can tell you it (the accident) was not intentional.”

But Justice Bongiorno deemed Mr Kang an “unacceptable risk”.

“Bail is rejected on the seriousness of the charges,” Justice Bongiorno said.

Mr Kang will front Geelong Magistrates’ Court on Wedneday.
